Upcoming Employment Law Reforms: What Employers Need to Know for 2026

Sep 22, 2025

In today’s fast-evolving legal landscape, it’s fair to say that employers are facing one of the
most challenging periods in recent memory. With significant legislative reforms on the
horizon, staying compliant may seem daunting, but there’s no need to panic!

The key lies in preparation: ensuring staff are properly trained, policies and contracts are
up-to-date, and that you have a clear understanding of what lies ahead.
One of the most notable developments is the Employment Rights Bill, currently
progressing through Parliament. Expected to become law later this year, this bill is being
heralded as the most substantial overhaul of employment rights in a generation. While the
full scope is extensive, here are some of the key highlights set to come into force in 2026:

April 2026: Key Changes to Employee Rights

1. Day One Rights for Paternity and Unpaid Parental Leave
2. Statutory Sick Pay (SSP) Reform
3. Introduction of the Fair Work Agency (FWA)
4. Restricting ‘Fire and Rehire’ Practices
5. Tighter Rules Around Tipping
6. Duty to Inform Workers of Union Rights
7. Strengthened Protection Against Sexual Harassment
8. Protection from Third-Party Harassment
9. Extended Employment Tribunal Claim Periods

Next Steps: Prepare, Don’t Panic

While these reforms are substantial, the best approach for businesses is to prepare early.
Now is the time to:

● Review and update employment contracts, HR policies etc
● Conduct staff and manager training sessions● Audit your workplace practices for legal compliance – good recordkeeping is
particularly key here to protect businesses from legal claims
● Review your payroll systems to ensure that they meet legal requirements and
calculate accurate payments.
● Understand how the changes will specifically impact your organisation
